TERMS & CONDITIONS – SBC
These Terms and Conditions (“Terms”) apply to every order placed through SBC’s online store.
By placing an order, the customer confirms they have read and accepted these Terms, to the exclusion of any other terms, unless explicitly agreed in writing by SBC.
Article 1 – Definitions
For the purposes of these Terms:
Cooling-off period – The period during which the Consumer may exercise the right of withdrawal.
Consumer – A natural person acting outside their trade, business, craft, or profession who enters into a distance contract with SBC.
Day – Calendar day.
Long-term transaction – A distance contract involving the periodic delivery of goods or services.
Durable medium – Any tool that allows the Consumer or the Trader to store information personally addressed to them in a way that can be accessed in the future for an adequate period and allows unchanged reproduction of the stored information.
Right of withdrawal – The right of the Consumer to withdraw from the contract within the cooling-off period.
Model withdrawal form – The form provided by SBC to enable the Consumer to exercise the right of withdrawal.
Trader – SBC.
Distance contract – A contract concluded exclusively using one or more means of distance communication.
Means of distance communication – Any tool that can be used for concluding a contract without the Consumer and Trader being physically present together.
Terms and Conditions – The present provisions of SBC.
Article 2 – Applicability
These Terms apply to every offer from SBC and every contract concluded via the online store.
The Terms are made available to the Consumer before or during the ordering process in a way that allows them to be stored.
If additional terms apply, the provision most favourable to the Consumer shall prevail in the event of inconsistencies.
If any provision is found invalid, the remaining provisions remain in force. Any gaps will be filled in accordance with the purpose and intent of these Terms.
Article 3 – The Offer
SBC reserves the right to modify or withdraw offers.
Offers include a clear description and, where applicable, images.
Images are for illustrative purposes only; variations in colour or shape may occur.
Each offer includes, at a minimum:
Price including VAT.
Duration of the offer.
Article 4 – Formation of the purchase
The purchase is formed when the Consumer accepts the offer and complies with the stated conditions.
SBC will confirm orders by email. Until receipt of this confirmation, the Consumer may cancel the order.
SBC implements appropriate security measures for electronic payments.
SBC may refuse an order if there are valid reasons, such as payment risks.
Upon delivery, SBC will provide information on the right of withdrawal, complaints procedure, warranties, and the company’s physical address.
Article 5 – Right of Withdrawal
6.1 Products
The Consumer may withdraw from the purchase within 14 days after receiving the goods, without giving reasons. The goods should be returned, where reasonably possible, in their original condition and unopened packaging.
Article 6 – Costs in Case of Withdrawal
Only the direct costs of returning goods are borne by the Consumer.
Any amounts already paid will be refunded within 14 days after withdrawal, provided the goods have been received by SBC or proof of return has been supplied.
Article 7 – Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
Custom-made goods or goods produced according to the Consumer’s specifications.
Opened products.
Article 8 – Prices
All prices include VAT and are subject to typographical errors.
Prices will not be increased during the validity period of the offer, except for changes in VAT rates or legal provisions.
Article 9 – Delivery and Execution
Orders will be delivered as quickly as possible and no later than 30 days unless otherwise agreed.
In the event of delays, the Consumer will be informed and may cancel the order without cost.
Risk of loss or damage passes to the Consumer upon delivery.
Article 10 – Complaints Procedure
Complaints must be submitted in writing within 3 days of delivery.
SBC will respond within 1-3 days of receipt of the complaint.
Article 11 – Applicable Law and Jurisdiction
All purchases are governed exclusively by Belgian law.
